California BPPE Consultants: Approval to Operate, SB 1247 Compliance, and More

Many new school owners are unaware that most California schools, colleges, and universities require state approval to operate from the Bureau for Private Postsecondary Education (BPPE), and that the consequences for operating without approval can be severe: The BPPE’s Enforcement Division is actively investigating unapproved schools, and issuing abatement orders, tuition restitution orders, and assessing fines of up to $50,000. Disciplinary Actions are posted on the BPPE website for viewing by students and other interested parties. Only a few types of private postsecondary education providers qualify for exemption from BPPE oversight; contrary to popular belief, “studios,” “workshops,” and not-for-profit organizations must, in many cases, obtain state approval to operate. Further, since the implementation of CA SB 1247 in January of 2015, all currently unaccredited degree-granting institutions are required to undergo accreditation as a condition of approval to operate. Colleges and universities that received BPPE approval to operate on or before January 1, 2015 must submit accreditation plans (by July 1, 2015) that identify the U. S. Department of Education-approved accrediting agency from which the institution will seek accreditation and the process by which the institution will achieve accreditation candidacy or pre-accreditation by July 1, 2017, and full accreditation by July 1, 2020.
